Administrative Requirements

Single Points of Contact Review

Executive Order 12372 requires applicants from state and local government units or other organizations providing services within a state to submit a copy of the application to the State Single Point of Contact (SPOC) if one exists and if this program has been selected for review by the state. Applicants must contact their SPOC to determine if the program has been selected for state review. The date that the application was sent to the SPOC, or the reason such submission is not required, should be entered in block 16 on the Application for Federal Assistance, SF 424.

Grant Funds Must Supplement and Not Supplant

The grantee will be required, in its award acceptance documents, to sign a special condition certifying that federal funds will be used to supplement existing funds and not replace funds that have been appropriated for the same purpose. For example, if a grantee prior to submitting an application had committed to develop and implement a program, then the grantee must make those dollars available in addition to those requested under this program. Potential supplanting will be the subject of application review, preaward review, postaward monitoring, and audit. If there is a potential presence of supplanting, the applicant or grantee will be required to supply documentation demonstrating that the reduction in nonfederal resources occurred for reasons other than the receipt or expected receipt of federal funds.

National Environmental Policy Act

All proposals for legislation and other major federal actions significantly affecting the quality of the human environment are subject to the provisions of National Environmental Policy Act (NEPA) and related federal environmental laws. The Regulation for Implementing the Procedural Provisions of the National Environmental Policy Act, issued by the Council on Environmental Quality, define the category of federal actions that apply to federal grant programs and trigger NEPA implementation.

NEPA requires the preparation of an environmental assessment in order to determine if the project will have a significant impact on the environment, and/or a more detailed environmental impact statement if significant impact is expected to result from the federal action.

Most sex offender management projects will not be affected by NEPA. If, however, a project involves minor renovation, construction, or any other activity that may have a significant impact on the environment or there is a change in the use or function of a facility, the grantee should provide a full description of the proposed project to BJA prior to implementation. A determination will be made at that time as to whether any further action is necessary.

Reporting Requirements

Grantees are required to submit semiannual progress reports, quarterly financial status reports, and annual audit reports. Any future awards with OJP and drawdowns of funds will be withheld if the progress, financial, and audit reports are delinquent.
